African Vacation Spots offers a variety of tours, Hotel, Lodges, Camps booking and other ticket services (“products”) through its website (AfricanVacationSpots.com) and through designated partner websites (‘African Vacation Spots-affiliated websites’ for information on African Vacation Spots Affiliate programs).

Because our Terms & Conditions contain legal obligations, we encourage you to read them carefully. They form the basis on which bookings are accepted by African Vacation Spots.

Unless otherwise stated, purchases made through africanvacationspots.com or any African vacation spots-affiliated website are subject to these Terms & Conditions; in all booking arrangements, the person making the booking shall be deemed to have accepted these conditions on behalf of the persons named in the booking.

No variation to these Terms & Conditions shall be of any effect unless made in writing by and with the authority of African Vacation Spots.

Terms of Use

  1. By using Africanvacationspots.com or any African vacation spots-affiliated website, you agree to be legally bound by these terms, which shall take effect immediately.

You agree not to use robots or other automated means to access this site, unless specifically permitted by African vacation spots.You represent and warrant that you (a) have not previously been suspended by African Vacation Spots or otherwise banned from the site; (b) are not a direct competitor of African Vacation Spots (c) do not have more than one African Vacation Spots account at any given time; and (d) that you have full power and authority to enter into these Terms of Service and in doing so will not violate any other agreement to which you are a party. We grant you permission to use the site subject to the restrictions in these Terms & Conditions. In accessing or using the site, you may be exposed to content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. African Vacation Spots does not endorse such content, and cannot vouch for its accuracy. You therefore access and use the site at your own risk.

User Accounts

  1. You need to create an account and provide information about yourself in order to use some of the features on the site. You are responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account.
  2. Your account is for your personal, non-commercial use only. You may not impersonate someone else (e.g., adopt the identity of a celebrity), create an account for anyone other than yourself, provide an email address other than your own, or create multiple accounts.
  3. We reserve the right to close your account at any time for any or no reason.


  1. You can contribute to the site in a number of different ways, including writing reviews, uploading photos, filling out your public profile, and rating other users' contributions (your "Content").

You may expose yourself to liability if, for example, Your Content violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is false, intentionally misleading, or defamatory; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation.
  5. We may remove or reinstate user Content from time to time at our sole discretion. For example, we may remove a review if we believe it violates our content guidelines. We have no obligation to retain or provide you with copies of your Content, nor do we guarantee any confidentiality with respect to your Content.
  6. African Vacation Spots and its affiliates may display advertisements and other information adjacent to or included with your Content on the Site and Other Media. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you.

Product Validity, Modifications & Amendments

  1. All products, tours and services offered by African Vacation Spots are valid as per the dates displayed at African vacation spots.com or any African vacation spots-affiliated website. African Vacation Spots is not responsible or liable for any information that it does not directly provide.
  2. To make a firm Tour booking and contract with African Vacation Spots a completed and signed booking form (the Booking Form) is required together with a 30% deposit of the value of the quoted holiday (the Holiday Price). Upon receipt of this signed booking form and deposit, a valid and binding contract is made between the Company and you the client, with the balance of payment due eight weeks before the departure date of the quoted holiday (the Departure Date). If both are not received, we reserve the right to cancel the arrangements and levy cancellation charges in line with clause
  3. When the booking is made less than eight weeks before travel, full payment of the invoice must be made. Tickets and other documents will normally be sent to you 24-72 hours after booking. In some instances, you may receive supplementary tickets and documents on arrival in the country of destination from our ground operators
  4. Occasionally our suppliers and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, etc. As a result, AVS reserves the right to cancel, change or substitute any service, tour, ticket or product that you have booked at AVS.com or through AVS-affiliated websites, at any time, for any reason.
    1. In such cases, if you are dissatisfied with the alternatives offered, you are entitled to a full refund of the original purchase price.
    2. Notwithstanding the above, when we are informed in advance by our agents, service providers and/or suppliers of a significant change to a booking and/or to a tour, product or event, we make every reasonable effort to notify the consumer, travel agent and/or distributor as appropriate, in order to amend or re-issue the booking where feasible.
  5. For products noted as a "Worry-free Shore Excursion", if you are not returned to the ship in time to board, we will arrange the necessary transport to the next port-of-call. This policy applies only to our contracted local suppliers and only when, through no fault or action of your own, you are not returned to the ship in time to board. The policy is void in instances where delay is caused by your own actions and/or you have deviated from the AVS activity or tour. You must supply AVS with correct arrival and departure ship information and ensure there is enough time (min. 2 hours) between the tour end time and the ship departure time. You must contact AVS directly to request next port-of-call transportation arrangements as customers cannot book their own travel. AVS will select and book travel to the next port of call (not to exceed US$1000 per person). In addition, if your ship misses a port of call or is delayed beyond the commencement time of your Worry-free Shore Excursion, simply contact AVS within 14 days. Pending verification of the ships actual itinerary, we will issue you a refund.


  1. A 30% non-refundable deposit is required when booking Tour Safari to receive booking confirmation.
  2. The balance is due 60 days prior to arrival date.
  3. For trips booked that are under 60 days, which we consider, "last-minute", 100% will be required.

Payments & Cancellations

  1. All cancellations must be received in writing.
  2. Any cancellation or no-show is subject to cancellation charges as per the following schedule: 

    Tour Package Cancellation

    1. From booking time to 60 days prior: 80% tour cost t 
      59 - 45 days prior: 80% tour cost will be refunded 
      44 - 35 days prior: 80% tour cost will be refunded 
      30 - 0 days prior: 0% tour cost will be refunded 
    2. 30days or less prior or no show: 100% tour cost will be deducted, 0% will be refunded There are no refunds for unused portions of the program, and refunds will not be made to clients who do not complete the tour for any reason whatsoever Our quotations are always based on per person unless stated otherwise, Amendments made to the itinerary once paid for may result in additional costs.
    3. We advise you get Tour package insurance for your trip.
    4. Hotel, Camps, Lodges and Resort hotel
    5. All hotel, Camps, Lodges and Resort cancellations will follow Hotel/Camps/lodges/resort terms and condition.

    7. Vacation Home Rentals only
      1. If, as a Guest, you cancel your requested booking before the requested booking is confirmed by a Host, Africavacationspots will cancel any pre-authorization to your credit card and/or refund any nominal amounts charged to your credit card in connection with the requested booking within a commercially reasonable time. If, as a Guest, you wish to cancel a confirmed booking made via the Site, Application and Services, either prior to or after arriving at the Accommodation, the cancellation policy of the Host contained in the applicable Listing will apply to such cancellation. Our ability to refund the Accommodation Fees and other amounts charged to you will depend upon the terms of the applicable cancellation policy. The Guest Fee is non-refundable regardless of the cancellation policy selected by the Host.
      2. Who can host on African Vacation Spot Home Rental
      3. It's free to sign up and list your space. The listings available on the site are as diverse as the hosts who list them, so you can post airbeds in apartments, entire houses, rooms in bed-and-breakfasts, boats on the water, or enchanted castles, villas.
      4. You can list your space in almost any location worldwide. While we would like to keep the Africa vacation spot home rental marketplace open to the entire African Continent, we are required to comply with US federal regulations that restrict the use of our site by residents of certain countries.
      5. What should I choose for my room type?
      6. All listings are categorized into the following three room types: shared rooms, private rooms, and entire homes/apartments. As a host, you're responsible for accurately describing your listing, so make sure you choose the appropriate room type.
      7. Shared rooms: guests share the entire space with you or others and don't have a room to themselves.
      8. Private rooms: guests share some spaces with you, like the kitchen, living room, or bathroom, but they have their own private room for sleeping.
      9. Entire homes/apartments: guests rent the entire property and do not have to share the space with you or with anyone else.
      10. How do I list multiple rooms?
      11. To list multiple rooms in the same building, you need to create a separate listing for each space you have available to rent. Each listing has its own calendar and description. Make sure each one accurately reflects the number of beds and amenities that you can accommodate, as well as describes what space will be shared with others. Only one reservation per listing can be booked at a time. The calendar is marked as unavailable for each pending or accepted reservation to prevent double-booking.
      12. For example, if you run a bed and breakfast with 8 rooms, you should create 8 Africa vacation spots rental home listings. Guests who want to book multiple rooms can book at each individual listing. To offer guests a discounted rate for booking multiple rooms, simply make a special offer and block the calendar of the other listings they will be staying in to avoid double-booking.
      13. You can also create a listing for your whole house and separate listings for individual rooms in the house, but be sure to keep up with your calendars. If you rent your entire house, block those dates on all the individual rooms so you won't double-book.
      15. Adding amenities to my listing
      17. We recommend including extra details about these popular amenities, so that guests know what to expect when they arrive.
      18. Internet—Tell guests whether or not they’ll have access to the Internet in your space. There's a separate amenity option specifically for Wireless Internet, so be sure to choose the option that accurately reflects how your guests can get online. Remember to share instructions and passwords with guests who have confirmed a reservation.
      19. Kitchen items—If guests want to cook, will they have access to plates, pots, utensils, and basic supplies like cooking oil and salt?
      20. Parking—Warn guests if it’s difficult to park near your listing, or highlight a nearby garage.
      21. Towels & Linens—Be sure to tell guests if you provide towels and linens, or if they need to bring their own.
      22. Heat & Air Conditioning—Be clear about climate control. Confirm that you have a heater, fan, or air conditioner, and make sure these items are working.
      23. TV—Let guests know if your space has a TV.
      24. Generator or Solar Panels – If you provide another source of energy/power that will help when there is a blackout due to unknown reason, let them know in advance so they know they wont be spending there vacation in the darkness.
      25. Toiletries—If you provide your guests with a hairdryer, soap, or shampoo, let them know in advance so they can save some room in their suitcase. (Adding filter search results by the items hosts have in the amenities section of their listing)
      26. Restrictions on what can be listed
      27. We welcome many different kinds of listings on our site as long as they meet the following criteria:
      28. The listing is used solely for lodging
      29. The listing, if a mobile home, sailboat, yacht, or other vessel, will be semi-permanently attached to a set location for the duration of a reservation
      30. The listing is accurately portrayed, located where the host says it is, and is bookable by the host
      31. Listings that don’t meet these criteria will be removed, such as:
      32. Motor vehicles or watercraft intended for mobile use
      33. Any listing whose primary purpose is other than serving as a lodging for example guest house.
      34. If we discover a listing that doesn’t meet our guidelines, we may exercise our discretion to limit, suspend, deactivate, or cancel the host's account.       35. Can I install video or audio surveillance in my listing?
      36. We expect hosts to respect their guests’ privacy. Although we can’t provide you with specific legal advice, the use of surveillance equipment may violate the law in your jurisdiction. Notify your guests about any security cameras or other surveillance devices at or around your listing and get consent where required.

      38. Travelers need to get a sense of who you are and what your listing has to offer, before they'll feel comfortable requesting a reservation. Creating a detailed profile and accurate listing will attract guests and set their expectation
      39. Your Listing Information
      40. Use high-quality photos, write a detailed description of the space, select the correct property type and highlight the amenities you have.
      41. Make clear what isn’t available to guests—if you don’t have reliable hot water, say so.
      42. Let guests know if there are parts of the listing that are off-limits, like a shared backyard or the attic.
      43. Provide detailed House Rules that address the situations that will matter to your guests. If you don't want your guests bringing other people into the space, tell them in advance.
      44. Be honest and candid about the unexpected factors that will impact your guests' stay. If your neighbors just started a noisy construction project, your guests deserve to know
      45. Pricing
      46. Guests will evaluate the value of your listing, so it's important to set a price that balances expectations with what your listing has to offer. When you're setting your price, make adjustments based on nearby listings with similar accommodations. You can always set weekend rates or adjust your prices to match seasonal trends .If you're a first-time host, consider lowering your rate so that you can get that first booking, gain some experience, and start developing your hosting style.       47. Calendar & Availability
      48. This will allow guests to book your space with or without having to send you a request. It will only apply to reservations that start on the specific dates you choose or for a guest who wants to stay for fewer nights than your minimum requirement. Create calendar to check pricing and availability that will display nightly rates and weekend rates, if the host has more than one calendar listing should be able to view multiple calendar
      49. AVS Customer guest service fees
      50. We charge a 12% guest service fee every time a reservation is booked. This covers the cost of running Africa Vacation Spots Rental Home. Service fees are calculated from the reservation subtotal, which is the price of a reservation that has been set (before service fees have been added).
      51. After entering the exact dates and number of guests for a reservation, guests will see the service fee included or quoted on a listing's page. The exact fee is located on the checkout page before submitting a reservation request and on any guest billing receipt.
      52. Depending on the laws of the jurisdiction involved, Vat on the service fees may be included as an additional amount over and above the total 12% service fee. The service fee presented will include such VAT when applicable. Please note that accommodation fees are charged to the guest directly by the host and may or may not contain local taxes including VAT as well, depending on the business status and local regulations applicable to the host.
      53. If a reservation request is retracted, expires or is declined, we do not charge the service fee. If a guest cancels a reservation, the service fee is non-refundable. If a guest chooses to be refunded after a host cancellation, the service fee is refunded. If a reservation is altered, the services fee adjusts according to the new subtotal.
      54. Host service fees
      55. Africa Vacation Spots Rental Home charges hosts a 3% host service fee every time a booking is completed on our online platform. This fee covers the cost of processing guest payments and comes out of the host payout. We also charge guests a guest service fee to cover the cost of running the site.
      56. Both guest and host service fees are calculated from the reservation subtotal. The subtotal is the complete price of a reservation before service fees have been added and is calculated from the listing's pricing settings. Our system can only process whole numbers and will round the fee to the nearest dollar.
      57. Depending on the laws of the jurisdiction involved, VAT on the service fees may be included as an additional amount over and above the total 3% service fee. The service fee presented to you on our website will include such VAT when applicable.
      58. You can see the amount of the service fee in your host confirmation by clicking on the reservation code in your Transaction History and when you receive a reservation request by clicking on the link next to the subtotal. ( what is our reservation code)
      59. Cancel my reservation request It depends. You can cancel your reservation request as long as it hasn’t been accepted by the host. Unfortunately, once a reservation has been accepted, any cancellations will be subject to the terms of the cancellation policy selected by the host.
      60. If you cancel a reservation request before it’s been accepted, you won't be charged for the reservation or Africa vacation spots home rental service fees.
      61. Cancel a reservation as a host
      62. If you need to cancel a guest's reservation, it’s important to do so as soon as possible. To cancel, go to your reservation, find the reservation you need to cancel, and click Change or Cancel.
      63. Canceling a guest's reservation can have serious implications on their trip, so, penalties will be applied for any cancellation that isn't due to an extenuating circumstance.
      64. Host Cancellation Penalties may include:
      65. A cancellation fee
      66. An automated review about the cancellation
      67. Unavailable/blocked calendar
      68. If you cancel before the reservation begins, your guest will receive a full refund.
      69. If you cancel after a reservation has already started, your guest will be fully refunded for the nights they weren’t able to stay in your space. Africa vacation spot rental home will automatically deduct the money from your next reservation payout.
      70. The cancellation penalties
      71. Because cancellations can have serious implications on a guest's trip, there are penalties that will be applied for host cancellations.
      72. A cancellation fee.
      73. If you cancel any reservation within 7 days of check-in, you'll be charged a $100 fee. Additionally, if you cancel more than one reservation within a six-month period, you'll be charged $50 per cancellation.
      74. We'll automatically deduct any applicable cancellation fees from your next payout.
      75. An automated review.
      76. A review will be posted to your listing's profile indicating that you canceled one of your reservations. We encourage you to publicly respond to clarify why you needed to cancel.
      77. Unavailable/Blocked calendar.
      78. Your calendar will stay blocked and you won't be able to accept another reservation for the same dates of the canceled reservation.
      79. Responsible Hosting
      80. We encourage hosts to think carefully about their responsibilities. Hosting offers rich experiences, but it comes with a certain level of commitment. In addition to the Hospitality Standards, here are some ways you can be a responsible host.
      81. Safety -What can do to make my space safe for guest? Emergency Procedures
      82. Contact Info:Indicate local emergency numbers and the nearest hospital. Provide a clear emergency contact number for yourself, as well as backup, for easy guest reference. Also make clear how you should be contacted if the guest has questions or issues arise.
      83. Supplies: Make a first aid kit easily available.
      84. Fire Prevention: Ensure you have a functioning smoke alarm and carbon monoxide detector, and that your property meets government safety guidelines for your area (e.g., International Building Code). Ensure you provide a functioning fire extinguisher and complete required maintenance.
      85. Exits: Ensure you have a clearly marked fire escape route, and post a map in your home.
      86. Minimize Hazards
      87. Privacy: Always be mindful of your guests' privacy. Fully disclose whether there are security cameras or other surveillance equipment at or around your listing. Make sure you are aware of and comply with applicable federal, state, and local laws.
      88. Occupancy: Establish safe occupancy limits - your local government may have guidelines.
      89. Access:Go through your home to identify any areas where guests might trip or fall and either remove the hazard or mark clearly. Fix any exposed wires. Ensure stairs are safe and have railings. Remove or lock up any objects that may be dangerous to your guests.
      90. Child-Proofing: Ensure your home is safe for children, or else notify guests of potential hazards.
      91. Climate: Ensure your home is properly ventilated and that temperature control is clearly marked and functional. Ensure guests are clear about how to safely use the heater/Air condition
      92. Neighbors how can I be mindful of my neighbors?
      93. Building Rules: Ensure you relay your building's common area rules to your guest. You may want to even notify your neighbors that you will have guests, and remind guests not to bother your neighbours (e.g., don't knock on their door or buzz them to let you in).
      94. Smoking: If you don't allow smoking, we suggest posting signs to remind guests. If you do allow smoking, ensure you have ashtrays available in designated areas.
      95. Parking: Ensure you relay parking rules for your building and neighbourhood to your guest.
      96. Noise:Remind guests about keeping noise down. You may want to consider whether you allow babies, pets, or parties. Develop a policy about guests inviting other people over, and ensure your guests are clear about your 'party policy.'
      97. Pets: If you allow pets, ensure guests are educated about things like local parks and local customs (e.g., cleaning up after your dog). Have a backup plan in case a guest's pet upsets the neighbours (such as the number of a nearby pet hotel).
      98. House Rules: To avoid surprises, you may want to include the information covered above in your House Rules in your Africa vacation spots rental home listing profile.
      99. Insurance what insurance should I get to cover my home?
      100. Basic Coverage: Review your renters or homeowners policy with your insurance carrier to make sure you have adequate coverage.

      105. How the Site, Application and Services Work
      106. The Site, Application and Services can be used to facilitate the listing and booking of residential and other properties (“Accommodations”). Such Accommodations are included in Listings on the Site, Application and Services by Hosts. You may view Listings as an unregistered visitor to the Site, Application and Services; however, if you wish to book an Accommodation or create a Listing, you must first register to create an Africa vacation spots-rental home Account (defined below).As stated above, Africa vacation spots-rental home makes available an online platform or marketplace with related technology for Guests and Hosts to meet online and arrange for bookings of Accommodations directly with each other. Africa vacation spots-rental home is not an owner or operator of properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or Accommodations, nor is it a provider of properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or Accommodations and Africa vacation spots-rental home does not own, sell, resell, furnish, provide, rent, re-rent, manage and/or control properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or Accommodations or transportation or travel services. Unless explicitly specified otherwise in the Africa vacation spots-rental home platform, Africa vacation spots –rental home responsibilities are limited to: (i) facilitating the availability of the Site, Application and Services and (ii) serving as the limited payment collection agent of each Host for the purpose of accepting payments from Guests on behalf of the Host.
      108. Application and Services, all Accommodations must have valid physical addresses. Listings will be made publicly available via the Site, Application and Services. Other Members will be able to book your Accommodation via the Site, Application and Services based upon the information provided in your Listing. You understand and agree that once a Guest requests a booking of your Accommodation, you may not request the Guest to pay a higher price than in the booking request.
      109. You acknowledge and agree that you are responsible for any and all Listings you post. Accordingly, you represent and warrant that any Listing you post and the booking of, or a Guest's stay at, an Accommodation in a Listing you post (i) will not breach any agreements you have entered into with any third parties, such as homeowners association, condominium, lease or rental agreements, and (ii) will (a) be in compliance with all applicable laws (such as zoning laws and laws governing rentals of residential and other properties), Tax requirements, and rules and regulations that may apply to any Accommodation included in a Listing you post (including having all required permits, licenses and registrations), and (b) not conflict with the rights of third parties. Please note that African vacation spots-rental home assumes no responsibility for a Host’s compliance with any agreements with or duties to third parties, applicable laws, rules and regulations. Africa vacation spots-rental home reserves the right, at any time and without prior notice, to remove or disable access to any Listing for any reason, including Listings that Africa vacation spots-rental, in its sole discretion, considers to be objectionable for any reason, in violation of these Terms or Africa vacation spots-rental then-current Policies and Community Guidelines (at African vacation spots.com/rental home/terms and conditions), or otherwise harmful to the Site, Application or Services.
      110. If you are a Host, you understand and agree that Africa vacation spots-rental home does not act as an insurer or as your contracting agent. If a Guest requests a booking of your Accommodation and stays at your Accommodation, any agreement you enter into with such Guest is between you and the Guest and Africa vacation spots –rental home is not a party thereto. Notwithstanding the foregoing, African vacation spots-rental home Payments serves as the limited authorized payment collection agent of the Host for the purpose of accepting, on behalf of the Host, payments from Guests of such amounts stipulated by the Host (including cleaning or other fees and/or Taxes).
      111. When you create a Listing, you may also choose to include certain requirements which must be met by the Members who are eligible to request a booking of your Accommodation, including, but not limited to, requiring Members to have a profile picture or verified phone number, in order to book your Accommodation. Any Member wishing to book Accommodations included in Listings with such requirements must meet these requirements. More information on how to set such requirements is available via the “Hosting” section of the Site, Application and Services. ( we need to create our own)
      112. If you are a Host, Africa vacation spots-rental home makes certain tools available to you to help you to make informed decisions about which Members you choose to confirm for booking for your Accommodation. You acknowledge and agree that, as a Host, you are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals who reside at or are otherwise present at the Accommodation at your request or invitation, excluding the Guest (and the individuals the Guest invites to the Accommodation, if applicable.)
      113. Africa vacation spots-rental home recommends that Hosts obtain appropriate insurance for their Accommodations. Please review any insurance policy that you may have for your Accommodation carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Guests (and the individuals the Guest invites to the Accommodation, if applicable) while at your Accommodation.
      114. Africa vacation spots-rental home may offer Hosts the option of having photographers take photographs of their Accommodations. If you as a Host choose to have a photographer do this, the photographs taken will be made available to you to include in your Listing with a watermark or tag bearing the words “Africa vacation spots.com Verified Photo” or similar wording (“Verified Images”). All images, materials and content created by these photographers provided by Africa vacation spots-rental home, including Verified Images, constitute Africa vacation spots-rental home Content, regardless of whether you include them in your Listing. No Endorsement
      115. African vacation spots-rental home does not endorse any Member or any Accommodation. You understand that Verified Images are intended only to indicate a photographic representation of the Accommodation at the time the photograph was taken. Verified Images are therefore not an endorsement by African vacation spots-rental home of any Member or any Accommodation. Members are required by these Terms to provide accurate information, and although African vacation spots-rental home may undertake additional checks and processes designed to help verify or check the identities or backgrounds of users, we do not make any representations about, confirm, or endorse any Member or the Member’s purported identity or background.
      116. Any references in the Site, Application or Services to a Member being “verified” or “connected” (or similar language) only indicate that the Member has completed a relevant verification process, and does not represent anything else. Any such description is not an endorsement, certification or guarantee by African vacation spots-rental home about any Member, including of the Member’s identity and whether the Member is trustworthy, safe or suitable. Instead, any such description is intended to be useful information for you to evaluate when you make your own decisions about the identity and suitability of others whom you contact or interact with via the Site, Application and Services. We therefore recommend that you always exercise due diligence and care when deciding whether to stay with a Host or to accept a booking request from a Guest, or to have any other interaction with any other Member. Except as provided in the African vacation spots-rental home Host Guarantee Terms and Conditions (“African vacation spots-rental home Host Guarantee”, at www.africavacationspots.com ,
      117. which is an agreement between African vacation spots-rental home and Hosts, we are not responsible for any damage or harm resulting from your interactions with other Members.
      118. By using the Site, Application or Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Members or other third parties will be limited to a claim against the particular Members or other third parties who caused you harm. You agree not to attempt to impose liability on or seek any legal remedy from African vacation spots-rental home with respect to such actions or omissions. Accordingly, we encourage you to communicate directly with other Members on the Site and Services regarding any bookings or Listings made by you. This limitation shall not apply to any claim by a Host against African vacation spots-rental home regarding the remittance of payments received from a Guest by African vacation spots-rental home on behalf of a Host, which instead shall be subject to the limitations described in the section below entitled “Limitation of Liability”. Security Deposits
      119. Hosts may choose to include security deposits in their Listings (“Security Deposits”). Each Listing will describe whether a Security Deposit is required for the applicable Accommodation. If a Security Deposit is included in a Listing for a confirmed booking of an Accommodation, Africa vacation spots-rental home Payments will, in its capacity as the payment collection agent of the Host, use its commercially reasonable efforts to obtain a pre-authorization of the Guest’s credit card in the amount the Host determines for the Security Deposit within a reasonable time prior to the Guest’s check-in at the applicable Host’s Accommodation. Africa vacation spots-rental home will also use its commercially reasonable efforts to address Hosts’ requests and claims related to Security Deposits, but Africa vacation spots-rental home is not responsible for administering or accepting any claims by Hosts related to Security Deposits, and disclaims any and all liability in this regard. Service Fees
      120. In consideration for the use of Africa vacation spots-rental home online marketplace and platform, Africa vacation spots-rental home charges the Service Fees. Where applicable, Taxes (such as VAT in Africa) may also be charged in respect of the Host Fees and Guest Fees. Africa vacation spots-rental home Payments deducts the Host Fees from the Accommodation Fees before remitting the balance to the Host as described in these Terms. Guest Fees are, as noted above, included in the Total Fees.
      121. Balances will be remitted by Africa vacation spots-rental home Payments to Hosts via check, PayPal, direct deposit or other payment methods described on the Site or via the Application, in the Host’s currency of choice, depending upon the selections the Host makes via the Site, Application and Services. Amounts may be rounded up or down as described the “Rounding Off” section below.
      122. Please note that Africa vacation spots-rental home Payments, may impose or deduct foreign currency processing costs on or from any payments or payouts by Africa vacation spots-rental home in currencies other than U.S. dollars.       123. Cancellations and Refunds
      124. If, as a Guest, you cancel your requested booking before the requested booking is confirmed by a Host, Africa vacation spots –rental home Payments will cancel any pre-authorization to your credit card and/or refund any nominal amounts charged to your credit card in connection with the requested booking within a commercially reasonable time. If, as a Guest, you wish to cancel a confirmed booking made via the Site, Application and Services, either prior to or after arriving at the Accommodation, the cancellation policy of the Host contained in the applicable Listing will apply to such cancellation. Our ability to refund the Accommodation Fees and other amounts charged to you will depend upon the terms of the applicable cancellation policy. Details regarding refunds and cancellation policies are available via the Site and Application. The Guest Fee is non-refundable regardless of the cancellation policy selected by the Host.
      125. If a Host cancels a confirmed booking made via the Site, Services, and Application, (i) Africa vacation spots –rental home Payments will refund the Total Fees for such booking to the applicable Guest within a commercially reasonable time of the cancellation and (ii) the Guest will receive an email or other communication from Africa vacation spots –rental home containing alternative Listings and other related information. If the Guest requests a booking from one of the alternative Listings and the Host associated with such alternative Listing confirms the Guest’s requested booking, then the Guest agrees to pay Africa vacation spots –rental home the Total Fees relating to the confirmed booking for the Accommodation in the alternative Listing, in accordance with these Terms. If a Host cancelled a confirmed booking and you, as a Guest, have not received an email or other communication from Africa vacation spots –rental home , please contact Africa vacation spots –rental home at www.africavacationspots.com
      126. If, as a Host, you cancel a confirmed booking, Africa vacation spots –rental home may apply penalties or consequences to you or your Listing, including (i) publishing an automated review on your Listing indicating that a reservation was cancelled, (ii) keeping the calendar for your Listing unavailable or blocked for the dates of the cancelled booking, or (iii) imposing a cancellation fee (to be withheld from your future payouts). You will be notified of the situations in which a cancellation fee applies before you decide to cancel.
      127. In certain circumstances, Africa vacation spots –rental home may decide, in its sole discretion, that it is necessary or desirable to cancel a confirmed booking made via the Site, Application and Services. This may be for reasons set forth in Africa vacation spots –rental home Extenuating Circumstances policy at Africa vacation spots –rental home Payments may also determine, in its sole discretion, to refund to the Guest part or all of the amounts charged to the Guest in accordance with the Guest Refund Policy at www.africavacationspots.com
      128. You agree that Africa vacation spots –rental home and the relevant Guest or Host will not have any liability for such cancellations or refunds.
